<p>Chinese auto giant BYD on Friday dethroned U.S. rival <span class="QuoteInBody-quoteNameContainer" data-test="QuoteInBody" id="RegularArticle-QuoteInBody-1">Tesla<span class="QuoteInBody-inlineButton"><span class="AddToWatchlistButton-watchlistContainer" id="-WatchlistDropdown" data-analytics-id="-WatchlistDropdown"><button class="AddToWatchlistButton-watchlistButton" aria-label="Add To Watchlist" data-testid="dropdown-btn"><span class="AddToWatchlistButton-addWatchListFromTag"/></button></span></span></span> as the world&#8217;s biggest seller of electric vehicles on a calendar-year basis.</p>
<p>The milestone caps an extraordinary rise for BYD, a company Tesla CEO Elon Musk once dismissed by laughing at their products during a 2011 Bloomberg interview. </p>
<p>In a <a href="https://www.hkexnews.hk/listedco/listconews/sehk/2026/0101/2026010100129.pdf" target="_blank" rel="noopener">statement</a> published Thursday, BYD said sales of its battery-powered cars rose nearly 28% to 2.26 million units.</p>
<p>Musk openly laughed at the mention of BYD while being interviewed on Bloomberg TV in October 2011. He said he did not see the company as a competitor to Tesla, adding: &#8220;I don&#8217;t think they have a great product.&#8221;</p>
<p>Meanwhile, Tesla <a href="https://ir.tesla.com/press-release/tesla-fourth-quarter-2025-production-deliveries-deployments" target="_blank" rel="noopener">said</a> Friday it delivered 1.64 million vehicles in 2025, in line with a company-compiled estimate of 1.6 million vehicle deliveries. The annual figure is roughly an 8% drop from 2024, the company&#8217;s second straight annual drop. </p>
<p>Deliveries for Q4 2025 were about 16% lower than the fourth quarter of 2024, when Musk&#8217;s EV company reported 495,570 deliveries. </p>
<p>Deliveries are the closest approximation of sales reported by Tesla, but are not precisely defined in the company&#8217;s shareholder communications. </p>

<p>Tesla has endured a roller-coaster ride this year. The company saw shares collapse in the first quarter of 2025 amid stiff competition, particularly from Chinese EV manufacturers, and reputational fallout from Musk&#8217;s incendiary political rhetoric.</p>
<p>The stock price has come roaring back in recent weeks, however, notching an all-time closing high of $489.88 last month, after Musk said the company had been testing driverless vehicles in Austin, Texas, with no occupants on board, almost six months after launching a pilot program with safety drivers. </p>

<div data-brcount="27">The &#8216;God of Stocks&#8217; &#8211; Warren Buffett’s Berkshire Hathaway disclosed a new $1.2 billion stake in Constellation Brands and halted the sale of Apple shares after months of reductions, according to a regulatory filing. The investment firm also continued cutting its holdings in major banks, including Citigroup and Bank of America, while its cash reserves neared $325 billion.Berkshire reported holding 5.62 million shares of Constellation Brands at the end of December 2024. The stock, which includes beer brands such as Modelo Especial and Corona, rose 6.7% in after-hours trading following the disclosure. The investment marks a new position for Berkshire, which also holds a small stake in spirits company Diageo.</p>
<p>The regulatory filing showed that Berkshire’s Apple holdings remained at 300 million shares, valued at $75.1 billion, making it the investment firm’s largest common stock investment. Berkshire had sold 490 million Apple shares over the first nine months of 2024 but did not reduce its position in the fourth quarter.</p>
<p>In the financial sector, Berkshire slashed its Citigroup stake by 74% to 14.6 million shares and reduced its Bank of America holdings by 15% to 680.2 million shares. The investment firm has now cut its stake in Bank of America by a third since July. It also trimmed its holdings in Capital One and Brazilian fintech firm Nu Holdings.<br />Berkshire exited its position in Ulta Beauty, selling its entire stake in the cosmetics retailer after less than a year. It also sold off its holdings in the SPDR S&amp;P 500 ETF (SPY) and Vanguard S&amp;P 500 ETF (VOO).<br />Other notable investments included an 86% increase in Domino’s Pizza shares and additional purchases of Occidental Petroleum, bringing Berkshire’s total stake in the oil company to 264.2 million shares worth $13.05 billion.</p>
<p>Berkshire’s cash holdings reached $325.2 billion by the end of 2024, the filing showed. The company’s annual report, expected on February 22, will provide further details on its year-end financial results.</p>

<p>A company alleged to have fraudulently sold a face mask as N95-grade must refund more than $1.1 million to customers nationwide, the Federal Trade Commission announced Monday. </p>
<p>Razer and its affiliates advertised the Zephyr mask as N95-grade despite never submitting it for testing or certification by the Food and Drug Administration or National Institute for Occupational Safety and Health, the agency said. In ads and posts on social media, the Zephyr masks were touted as the equivalent of an N95 that would protect users from <span class="link"><a href="https://www.cbsnews.com/feature/coronavirus/" target="_blank" data-invalid-url-rewritten-http="" rel="noopener">COVID</a></span>, the FTC stated in a <a href="https://www.ftc.gov/system/files/ftc_gov/pdf/Razer-PACER-No1-Complaint.pdf" target="_blank" rel="nofollow noopener">complaint</a>. </p>
<p>&#8220;These businesses falsely claimed, in the midst of a global pandemic, that their face mask was the equivalent of an N95 certified respirator,&#8221; Samuel Levine, director of the FTC&#8217;s Bureau of Consumer Protection, said in a <a href="https://www.ftc.gov/news-events/news/press-releases/2024/04/razer-inc-pay-more-11-million-misrepresenting-performance-efficacy-supposed-n95-grade-zephyr-face" target="_blank" rel="nofollow noopener">statement</a>. &#8220;The FTC will continue to hold accountable businesses that use false and unsubstantiated claims to target consumers who are making decisions about their health and safety.&#8221;</p>

<p>Starting in October of 2021, the Zephyr mask and three sets of filters sold for $99.99; the Razer Zephyr Starter Pack containing a mask and 33 sets of filters sold for $149.99; and a Razer Zephyr Filter Pack containing 10 sets of filters sold for $29.99.</p>

<p>A representative for Razer couldn&#8217;t immediately be found for comment. </p>
<p>Razer and its related businesses are also barred from making COVID-related misrepresentations or unsubstantiated claims about protective equipment, the FTC said. In addition to covering full refunds to customers misled about the product they were buying, the sellers will pay a civil penalty of $100,000.</p>

<p>Shares of <span class="QuoteInBody-quoteNameContainer" data-test="QuoteInBody" id="RegularArticle-QuoteInBody-1">SenseTime<span class="QuoteInBody-inlineButton"><span class="AddToWatchlistButton-watchlistContainer" id="-WatchlistDropdown" data-analytics-id="-WatchlistDropdown"><button class="AddToWatchlistButton-watchlistButton" aria-label="Add To Watchlist" data-testid="dropdown-btn"><span class="AddToWatchlistButton-addWatchListFromTag"/></button></span></span></span> fell as much as 9.7% on Tuesday after U.S. short seller Grizzly Research alleged the Chinese artificial intelligence firm inflated its revenue.</p>
<p>SenseTime shares pared some of those losses in Hong Kong and closed 4.86% lower in the afternoon.</p>
<p>Grizzly Research <a href="https://grizzlyreports.com/we-believe-sensetime-is-artificially-unintelligently-inflating-revenue-through-highly-questionable-revenue-round-tripping-schemes/" target="_blank" rel="noopener">alleged in a report</a> on Tuesday that SenseTime engaged in a so-called &#8220;revenue round-tripping&#8221; program.</p>
<p>&#8220;SenseTime either directly or through intermediaries provides funds to customers that in turn are used to purchase goods from SenseTime that might never have been delivered,&#8221; Grizzly Research alleged. The short seller said it got this information via two court cases in China that described the scheme.</p>

<h2 class="ArticleBody-subtitle"><a id="headline0"/>SenseTime responds</h2>
<div class="group">
<p>SenseTime said in a Hong Kong Stock Exchange filing that it is &#8220;reviewing the allegations and considering the appropriate course of action to take to safeguard the interests of all shareholders.&#8221;</p>
<p>The Chinese firm said it believes Grizzly Research&#8217;s report is &#8220;without merit and contains unfounded allegations and misleading conclusions and interpretations.&#8221;</p>
<p>SenseTime added that the report &#8220;shows a lack of understanding of the Company&#8217;s business model and financial reporting structure, and a lack of thorough reading of the Company&#8217;s public filings.&#8221;</p>
<p>Grizzly Research did not contact SenseTime to verify the information, SenseTime said in its statement.</p>

<h2 class="ArticleBody-subtitle"><a id="headline1"/>SenseTime issues grow</h2>
<div class="group">
<p>SenseTime was once viewed as one of China&#8217;s most exciting artificial intelligence companies and is best-known for computer vision technology that can power facial recognition software.</p>
<p>However, the company has been a target of U.S. government sanctions. In 2019, Washington put SenseTime on the so-called Entity List, which restricts American firms from doing business with it. The U.S. alleged that SenseTime is linked to human rights violations in China&#8217;s Xinjiang region.</p>
<p>At the time, SenseTime said that it does &#8220;not have any business in, nor are we aware of our technology being used in the Xinjiang region.&#8221;</p>
<p>SenseTime proposed an initial public offering in Hong Kong in mid-2021 but postponed the listing later that year after the U.S. government added it to a list of &#8220;Chinese military-industrial complex companies.&#8221;</p>
<p>The company ended up doing its listing at the end of December, pricing shares at 3.85 Hong Kong dollars ($0.49). Shares closed at 1.37 Hong Kong dollars on Tuesday, 64% below their IPO price.</p>
<p>Due to SenseTime&#8217;s U.S. government blacklisting, the company &#8220;has a severely limited target market and therefore no outlook for any real improvement,&#8221; Grizzly Research said in its report.</p>
<p>The short seller also took aim at SenseTime&#8217;s technology, claiming it has &#8220;no competitive moat in AI.&#8221;</p>
<p>&#8220;We believe SenseTime is operating a fundamentally dead-ended facial recognition software business, plus some additional AI R&amp;D projects with almost no chance of scalable future profits,&#8221; Grizzly Research said.</p>

<p>The surge in housing demand in 2020 and 2021 was so substantial that <a href="https://www.federalreserve.gov/econres/feds/volatility-in-home-sales-and-prices-supply-or-demand.htm" target="_blank" rel="noreferrer noopener" class="sc-d4f8e0dd-0 iuAujS styledLinkColor ">Federal Reserve researchers</a> estimate that housing supply would have needed to increase by a staggering 300% in order to match the pandemic’s housing demand surge. This surge was primarily propelled by <a href="https://www.frbsf.org/economic-research/publications/working-papers/2022/11/" target="_blank" rel="noreferrer noopener" class="sc-d4f8e0dd-0 iuAujS styledLinkColor ">the shift to remote work</a> and the household formation boom triggered by the separation of roommates seeking greater space. At the peak of the Pandemic Housing Boom, only 546,151 homes were available for sale on Realtor.com in July 2021, a sharp decline from the 1,239,298 homes on the market in July 2019.</p>

<p>That housing demand boom was ultimately subdued by last year’s mortgage rate shock, which pushed the average 30-year fixed mortgage rate from a 3 handle to a 7 handle. </p>
<p>Did inventory surge back due to the impact of spiked mortgage rates? Not really, at least nationally. While the number of active listings for sale in July 2023 (646,698 homes) is 18% higher than levels in July 2021 (546,151 homes), it remains significantly lower, by 48%, compared to the pre-pandemic levels recorded in July 2019 (1,239,298).</p>
<p>Why hasn’t housing inventory for sale/active listings soared back to pre-pandemic levels given the ongoing housing affordability shock? There are two primary reasons. </p>
<p>Firstly, from an aggregate perspective, U.S. homeowners find themselves in a robust financial position, with <a href="https://fred.stlouisfed.org/series/MDSP" target="_blank" rel="noreferrer noopener" class="sc-d4f8e0dd-0 iuAujS styledLinkColor ">mortgage debt payments accounting for only 3.9% of U.S. disposable income</a> in the first quarter of 2023. This stands in stark contrast to the 7.2% recorded at the peak of the housing bubble in the fourth quarter of 2007. This absence of financial strain, combined with the ongoing strength of the labor market—<a href="https://fred.stlouisfed.org/series/UNRATE" target="_blank" rel="noreferrer noopener" class="sc-d4f8e0dd-0 iuAujS styledLinkColor ">marked by a mere 3.5% jobless rate</a>—results in a housing market characterized by a scarcity of “forced sellers” and a low occurrence of foreclosures.</p>
<p>Secondly, the phenomenon known as the “lock-in effect” has resulted in a significant reduction in the number of U.S. homes being placed on the market. This can be attributed to the rational decision-making of move-up buyers, who find it economically disadvantageous to sell their current homes, relinquishing their favorable 2% or 3% mortgage rates, only to acquire a new property with a higher 6% or 7% interest rate. This reluctance among sellers has led to a noteworthy decline in “new listings,” plummeting from 520,516 in July 2021 to a mere 374,028 in July 2023. That seller strike, and the dearth of new listings, presents a challenge for the ascent of active listings and the overall inventory count.</p>

<p>Among the nation&#8217;s 200 largest housing markets tracked by Realtor.com (see the searchable chart above), 193 markets had inventory levels in July 2023 that were below July 2019 levels. Only seven of those nation&#8217;s 200 largest housing markets are back to pre-pandemic levels. That includes Killeen-Temple, Texas; Lubbock, Texas; Kennewick-Richland, Wash.; Waco, Texas; Austin-Round Rock-Georgetown, Texas; Huntsville, Ala.; and Beaumont-Port Arthur, Texas. </p>
<p>Those seven markets, for the most part, have both a higher concentration of home building activity (i.e. higher levels of supply coming onto the market) while they also saw bigger than average demand pullbacks during last year&#8217;s mortgage rate shock.</p>
<p>It&#8217;s no surprise that Austin—arguably <a href="https://www.google.com/search?q=austin+msissed+2008&amp;rlz=1C5CHFA_enUS851US851&amp;oq=austin+msissed+2008&amp;aqs=chrome..69i57j69i64.2997j0j4&amp;sourceid=chrome&amp;ie=UTF-8" target="_blank" rel="noreferrer noopener" class="sc-d4f8e0dd-0 iuAujS styledLinkColor ">the epicenter of the bifurcated pandemic housing correction</a>—has seen a sharper tick up in inventory. The Pandemic Housing Boom was particularly fierce in the Austin market, where local prices soared 63% between March 2020 and May 2022. That home price jump, coupled with last year&#8217;s mortgage rate shock, simply pushed Austin home prices too far beyond fundamentals, thus spurring a home price correction.</p>
<p>That&#8217;s starkly different from what a Northeast market like Hartford, Conn. is seeing. Hartford home prices did boom during the pandemic, however, its 37% jump between March 2020 and May 2022 was less dramatic than in Austin. That might explain why the mortgage rate shock hasn&#8217;t translated into a big inventory jump in Hartford—where inventory/active listings remains 79% below pre-pandemic levels.</p>
<p>The substantial increase in Austin inventory has coincided with a 10.2% decline in home prices, as tracked by Freddie Mac, within the market from June 2022 to June 2023. Conversely, the notable decrease in inventory in Hartford has aligned with a local surge in home prices, which rose by 8% between June 2022 and June 2023.</p>
<p>Simply put, &#8220;all real estate is local&#8221; and inventory trends matter. </p>

<p>Ephraim &#8220;Ed&#8221; Rosenberg in March plead guilty to a criminal charge, stemming from a Sept. 2020 indictment that charged six people with conspiring to pay Amazon employees bribes in exchange for confidential information that would benefit third-party merchants selling goods on the company&#8217;s marketplace.</p>
<p>Rosenberg was sentenced Friday in a federal court to two years of probation, and 12 months of house arrest. He was also ordered to pay a $100,000 fine.</p>
<p>&#8220;Mr. Rosenberg&#8217;s illegal actions were harmful to the sellers who work hard every day to build a thriving business on Amazon, and today he was held accountable for his crimes,&#8221; Amazon spokesperson Mira Dix said in a statement. &#8220;When we uncovered the suspicious behavior related to this case in 2018, we reported it to the FBI and actively supported the ensuing investigation.&#8221;</p>
<p>Rosenberg, 48, is a well-known figure in the world of Amazon third-party sellers. He runs a consultancy business that advises entrepreneurs on how to sell products on the online marketplace, and navigate unforeseen issues with their accounts. Rosenberg&#8217;s Facebook group for sellers, ASGTG, has over 70,000 members, and he hosts a popular conference for sellers each year in his hometown of Brooklyn.</p>
<p>The case provides an unfiltered glimpse into the cottage industry of consultants and brokers that has flourished alongside the growth of Amazon&#8217;s third-party marketplace. Since its launch in 2000, the marketplace has become a lucrative and competitive platform for millions of sellers to market their wares. From May 2019 to May 2020, U.S. small and medium businesses selling on the marketplace had an average of over $160,000 in sales, according to <a href="https://www.businesswire.com/news/home/20200721005239/en/Amazon-2020-SMB-Impact-Report-Highlights-Success-for-Small-and-Medium-Sized-Businesses-Despite-COVID-19-American-Sellers-Average-160000-in-Annual-Sales" target="_blank" rel="noopener">a report issued</a> by Amazon.</p>
<p>While the marketplace has helped Amazon haul in tens of billions of dollars in sales, it&#8217;s also become a notorious host to counterfeit, unsafe and expired goods. Behind the scenes, scammers have for years resorted to illicit tactics to squash competitors, artificially boost their listings or bypass Amazon&#8217;s marketplace rules.</p>
<p>The case isn&#8217;t the first time Amazon has dealt with issues of company employees leaking confidential information or manipulating the site in exchange for payments. In 2018, the company investigated claims that employees, primarily based in China, who received payments worth $80 to more than $2,000, in exchange for access to internal data, <a href="https://www.wsj.com/articles/amazon-investigates-employees-leaking-data-for-bribes-1537106401" target="_blank" rel="noopener">The Wall Street Journal</a> reported.</p>
<p>Amazon has said it invests hundreds of millions of dollars per year to ensure products are safe and compliant. The <a href="https://www.wsj.com/articles/amazon-investigates-employees-leaking-data-for-bribes-1537106401" target="_blank" rel="noopener">provision</a> of internal data to sellers by employees violates Amazon&#8217;s seller policies and code of conduct.</p>
<p>Rosenberg&#8217;s punishment is far less severe than what other defendants have faced. A former Amazon employee was sentenced last year to 10 months in prison, while a consultant who also sold products on Amazon <a href="https://www.justice.gov/usao-wdwa/pr/amazon-seller-and-consultant-sentenced-20-months-prison-bribery-scheme-and-illegal" target="_blank" rel="noopener">is serving 20 months in prison</a>.</p>
<p>Prosecutors recommended a lesser sentence for Rosenberg because there was no evidence he initiated attacks on competitors&#8217; product listings like some of his conspirators, who allegedly lodged false complaints to Amazon, and bought fake negative reviews for rivals&#8217; products. Other defendants also pleaded guilty to tax evasion charges in addition to the bribery scheme.</p>
<p>Between July 2017 and Sept. 2020, Rosenberg paid bribes directly and indirectly to Amazon employees in order to steal confidential data, as well as gain access to internal systems. In one case, Rosenberg made 33 different PayPal payments worth $18,650 to an Amazon employee in Seattle in exchange for confidential information about third-party seller accounts.</p>
<p>Most of his payments were for account &#8220;annotations,&#8221; or an internal Amazon employee log of infractions on a sellers&#8217; account, which Rosenberg and another defendant, Joe Nilsen, covertly referred to as &#8220;fruit&#8221; in email correspondence.</p>
<p>&#8220;Sellers who had been suspended from selling on Amazon could use this internal information to see exactly what Amazon had figured out about the sellers&#8217; infractions and to tailor their appeals for reinstatement accordingly,&#8221; prosecutors alleged.</p>
<p>Nilsen bragged to Rosenberg over email about the services he had gained access to by bribing employees.</p>
<p>&#8220;I am not trying to make it seem like we have all the abilities in the world, but even though it took some time and some face to face meetings, we obtained abilities that still blow my mind,&#8221; Nilsen wrote in a Jan. 2018 email to Rosenberg, referring to his internal contacts as &#8220;high up &#8216;flick the switch&#8217; type guys.&#8221;</p>
<p>&#8220;I don&#8217;t want to have a little menu floating around but if you are in need of anything, just run it by me and I will let you know,&#8221; Nilsen continued.</p>
<p>Previously unsealed court documents said Rosenberg allegedly sent a &#8220;veiled threat&#8221; to an Amazon employee at the company&#8217;s Seattle headquarters as part of the bribery scheme, Bloomberg reported. The documents also detailed the defendants&#8217; elaborate efforts to dodge detection by authorities, including allegedly stuffing a llama-shaped ottoman with cash believed to be bribes, according to Bloomberg.</p>
<p>Rosenberg&#8217;s guilty plea in March marked a reversal of his position on the case. He repeatedly denied prosecutors&#8217; allegations and claimed in LinkedIn messages to CNBC he was being framed, as well as in posts on Reddit forums and Facebook groups. He later admitted he made false statements about the case and admitted to bribing Amazon employees in a public apology posted online.</p>
<p>An attorney for Rosenberg, Jacob Laufer, wrote in a sentencing memo that while Rosenberg&#8217;s conduct was illegal, it was a symptom of a marketplace ruthlessly governed by Amazon wherein merchants could be arbitrarily booted off the marketplace at any time, and struggling to get their businesses reinstated, turned to illicit tactics.</p>
<p>&#8220;Given that these sellers were in the dark about their alleged wrongdoing, how to correct the problem, and when Amazon might recognize its error, sellers were frequently desperate and sometimes would resort to illegal means to obtain the information necessary to accomplish the goal of saving their businesses,&#8221; according to the memo. &#8220;The &#8216;information necessary&#8217; was the annotations.&#8221;</p>
<p>Dix said Amazon has processes in place to help sellers avoid deactivation and get reinstated when appropriate. The company has for years been investing in improving its communications with sellers, speeding up response times and more clearly indicating policy violations, she added.</p>
<p>&#8220;There is no place for fraud at Amazon and no excuse for resorting to illegal activities,&#8221; Dix said in a statement.</p>
