<p>OpenAI CEO Sam Altman met with a handful of lawmakers in Washington, D.C. where Sen. Mark Kelly, D-Ariz., said he raised some &#8220;serious questions&#8221; about the company&#8217;s approach to warfare and its recent deal with the Department of Defense.</p>
<p>In an interview with CNBC&#8217;s Emily Wilkins, Kelly said the group talked &#8220;in detail&#8221; about surveillance and how artificial intelligence systems could be used within a kill chain. He called it a &#8220;good discussion.&#8221;</p>
<p>&#8220;There&#8217;s got to be guardrails in place, and we&#8217;ve got to make sure that we&#8217;re always thinking about the Constitution and making sure that we comply with it,&#8221; Kelly said.</p>
<p>OpenAI formed a deal with the DOD late last month just hours after rival Anthropic had been blacklisted by Defense Secretary Pete Hegseth, who <a href="https://x.com/SecWar/status/2027507717469049070?s=20" target="_blank">declared</a> the company a &#8220;Supply-Chain Risk to National Security.&#8221; </p>

<p>Anthropic had been trying to renegotiate its contract with the DOD, but the talks stalled over a disagreement about how the technology could be used. The DOD wanted Anthropic to grant the military unfettered access to its models for all lawful purposes, while Anthropic sought assurance that its models would not be used for fully autonomous weapons or domestic mass surveillance. </p>
<p>Altman said in <a href="https://x.com/sama/status/2027578580159631610?s=20" target="_blank">a post</a> on X the day the deal fell apart that prohibitions on domestic mass surveillance and human responsibility for the use of force, including for autonomous weapon systems, are two of the company&#8217;s &#8220;most important safety principles.&#8221; He said the DOD agreed and put them into the arrangement.</p>
<p>OpenAI <a href="https://openai.com/index/our-agreement-with-the-department-of-war/" target="_blank" rel="noopener">published</a> an excerpt of its contract with the DOD, which says that the agency &#8220;may use the AI System for all lawful purposes.&#8221; The company said it&#8217;s confident the DOD will not be able to use its AI systems for mass surveillance or fully autonomous weapons because of OpenAI&#8217;s safety stack, the contract language and existing laws. </p>
<p>&#8220;We think it&#8217;s very important to support the United States government and the democratic process,&#8221; Altman told CNBC on Thursday. He added that while OpenAI disagrees with the Pentagon&#8217;s decision to designate Anthropic a supply chain risk, he thinks the government needs to be able to make decisions about &#8220;how the most important things in the country are going to work.&#8221; </p>
<p>The clash between Anthropic and the DOD came as a shock to officials and technologists in Washington. Many had come to view Anthropic&#8217;s models as superior — they were the first to be deployed in the agency&#8217;s <a href="https://www.anthropic.com/news/statement-department-of-war" target="_blank" rel="noopener">classified networks</a> — and championed the company&#8217;s ability <a href="https://investors.palantir.com/news-details/2024/Anthropic-and-Palantir-Partner-to-Bring-Claude-AI-Models-to-AWS-for-U.S.-Government-Intelligence-and-Defense-Operations/" target="_blank" rel="noopener">to integrate</a> with existing defense contractors like Palantir. </p>
<p>Kelly is working with other senators to draft legislation that would set guardrails around DOD contracts with AI organizations, and said that Congress &#8220;needs to have a role.&#8221;</p>
<p>&#8220;We need to have legislation on this that creates some of these boundaries, guardrails,&#8221; he said. &#8220;This is the United States Congress, things don&#8217;t move as fast as we would like, but this technology is moving very quickly.&#8221;</p>

<p>Lawmakers this week plan to revisit efforts to pass a market structure bill that will determine the crypto industry&#8217;s future in the U.S. — reviving legislative efforts that stagnated last year.</p>
<p>On Thursday, the Senate Agriculture and Banking Committees are expected to hold hearings on their respective parts of the crypto bill, where they might revise the text. This will lay the groundwork for establishing legislative guardrails for digital assets in the U.S. — a potential watershed moment for the crypto industry. </p>
<p>This is what you need to know about the market structure bill and efforts to pass it. </p>
</div>
<h2 class="ArticleBody-subtitle"><a id="headline0"/>The bill&#8217;s objective</h2>
<div class="group">
<p>The so-called Clarity Act aims to provide legislative guardrails for the multitrillion-dollar crypto market and big digital asset firms — which could accelerate the adoption of blockchain technology and crypto in the U.S. </p>
<p>It seeks to clarify the Securities and Exchange Commission&#8217;s and Commodities Futures Trading Commission&#8217;s roles in regulating cryptocurrencies, in addition to creating more well-defined token classifications. It also aims to outline registration and compliance standards for a wide range of crypto brokerages, exchanges and other entities, enabling them to operate more easily in the U.S. </p>
<p>Those guardrails could help the U.S. court more digital assets companies to set up shop stateside, stimulating the economy and boosting the crypto market, according to Summer Mersinger, CEO of crypto trade group Blockchain Association.</p>
<p>&#8220;We&#8217;ve seen this massive movement of companies and activity back on shore because there is a friendly administration to crypto,&#8221; Mersinger said. But, without a market structure law, &#8220;that could all go away, especially if there&#8217;s a change to an unfriendly administration.&#8221;</p>
<p>That said, the bill&#8217;s implications for digital asset companies, crypto holders and other investors won&#8217;t be 100% clear until the draft legislation&#8217;s language is finalized. </p>
</div>
<h2 class="ArticleBody-subtitle"><a id="headline1"/>What&#8217;s happening this week</h2>
<div class="group">
<p>Lawmakers will attempt to hash out three key issues this week: stablecoin-linked rewards; the treatment of decentralized finance platforms and their developers; and the matter of blocking elected officials such as President Donald Trump from profiting off of crypto ventures. Trump-affiliated entities have launched both a memecoin and nonfungible token in the past. </p>
<p>The stablecoin issue is &#8220;the biggest outstanding issue&#8221; for negotiations on the Hill, said Cody Carbone, CEO of crypto trade association Digital Chamber.</p>
<p>&#8220;Stablecoin rewards, interest, yields, whatever you want to call it, will be addressed in the bill,&#8221; Carbone said. &#8220;Both Republicans and Democrats have come to that conclusion.&#8221;</p>
<p>In early January, the American Bankers Association&#8217;s Community Bankers Council <a href="https://www.aba.com/advocacy/policy-analysis/Letter-to-the-Senate-on-the-Stablecoin-Market" target="_blank" rel="noopener">wrote to Senate members</a>, asking them to prevent stablecoin issuer affiliates from offering rewards to customers. The stablecoin products, they said, exploit a loophole in the stablecoin-centric <a href="https://www.whitehouse.gov/fact-sheets/2025/07/fact-sheet-president-donald-j-trump-signs-genius-act-into-law/" target="_blank" rel="noopener">Genius Act passed last year</a> that prohibits dollar-pegged tokens that offer yields to holders — which pose an attractive alternative to high-yield savings accounts and other traditional products. </p>
<p>On the DeFi front, crypto advocates are fighting to ensure developers do not face prosecution when their technology is used for illicit activities like money laundering. </p>
<p>&#8220;We&#8217;re very conscious of how illicit finance is treated in the bill… but we need to make sure that there are not obligations put on codes instead of person, or make sure that there isn&#8217;t some inadvertent way that the technology is burdened in a way that it can&#8217;t comply,&#8221; DeFi Education Fund chief legal officer Amanda Tuminelli told CNBC. </p>
<p>DeFi advocates also want to ensure the market structure bill contains language allowing individuals to self-custody their crypto. In addition, they want provisions from the <a href="https://www.congress.gov/bill/119th-congress/house-bill/3533/text" target="_blank" rel="noopener">Blockchain Regulatory Certainty Act</a> that call for software developers and blockchain service providers who do not control or custody customer funds to be exempt from registering as money-transmitting businesses. </p>
<p>Finally, some lawmakers like Sen. Elizabeth Warren (D-Mass.) want to prevent public officials from profiting off of digital asset ventures while they serve. </p>
<p>&#8220; It&#8217;s a really hard issue,&#8221; Mersinger said. &#8220;They ended up kind of punting [on] it in the House because it was really difficult to put on the bill. A lot of Senate Democrats have said, &#8216;We&#8217;re not going to punt on this issue.'&#8221; </p>

<h2 class="ArticleBody-subtitle"><a id="headline2"/>&#8216;Key window&#8217;</h2>
<div class="group">
<p>The Senate Agriculture and Banking Committees are expected to put out new drafts of the market structure bill, with the aim of discussing and revising details of the proposed legislation Thursday at markup, according to Mersinger. </p>
<p>Later, they will join the two documents to create one big crypto bill. That draft will go to the Senate floor, where discussions could take several weeks, before potentially making its way through the rest of the lawmaking process to become law. </p>
<p>Crypto proponents want to see the bill passed before the 2026 midterm elections in case some of the industry&#8217;s allies are unseated in November and to avoid losing momentum on the Hill, Mersinger told CNBC. </p>
<p>&#8220;There&#8217;s a lot of other priorities Congress has on the books for this year, and so this is kind of the key window that they see to get something to move out of committee onto the floor and have the time that&#8217;s needed to get it done,&#8221; Mersinger said. </p>

<p>The Senate Agriculture Committee has released a draft of its portion of a much-awaited digital assets market structure bill — a critical step toward accelerating institutional and retail adoption of cryptocurrencies. </p>
<p>Unveiled on Monday by Agriculture Chair John Boozman, R-Ark., and Sen. Cory Booker, D-N.J., the bipartisan discussion draft lays the groundwork for creating guardrails for the crypto industry in the U.S. It also establishes guidelines for institutions that want to work with digital assets, from bitcoin and ether to tokenized financial instruments.</p>
<p>&#8220;This is the most consequential roadmap for how an institution is going to integrate digital assets into their business,&#8221; Cody Carbone, CEO of crypto trade association Digital Chamber, told CNBC. &#8220;It&#8217;s like the best possible step-by-step of what type of compliance rules requirements they would need to follow to work with crypto.&#8221;</p>
<p>Here are five key takeaways from the discussion draft.</p>
</div>
<h2 class="ArticleBody-subtitle"><a id="headline0"/>1. Grants favorable regulatory status to some cryptocurrencies</h2>
<div class="group">
<p>The text classifies some of the largest digital assets by market capitalization such as bitcoin and ether as &#8220;digital commodities,&#8221; placing them under the Commodity Futures Trading Commission&#8217;s purview.  </p>
<p>This provision removes a major blocker to digital asset adoption for institutional fiduciaries, Juan Leon, an analyst at crypto-focused asset manager Bitwise, told CNBC.</p>
<p>&#8220;Compliance and risk departments will finally have a federal statute to point to,&#8221; Leon said. &#8220;This shifts the internal conversation … [and] it provides the legal certainty required to move assets into a formal, strategic allocation.&#8221;</p>
<p>It will also create &#8220;a starkly bifurcated market&#8221; consisting of regulated and unregulated tokens, with the former class of assets seeing &#8220;a massive influx of institutional capital, deep liquidity and a robust derivatives ecosystem.&#8221;</p>
</div>
<h2 class="ArticleBody-subtitle"><a id="headline1"/>2. Requires crypto firms to segregate funds and manage conflicts of interest</h2>
<div class="group">
<p>The draft calls for crypto companies to &#8220;establish governance, personnel, and financial resource separation among affiliated entities that perform distinct regulated functions.&#8221;</p>
<p>Bitwise&#8217;s Leon interprets the provision as a challenge to the &#8220;all-in-one&#8221; business model that is common among crypto exchanges. According to those models, an exchange, broker, custodian, and proprietary trading desk are all wrapped up into one entity. </p>
<p>In other words, digital asset firms could be required to keep their various businesses separated like traditional financial companies, according to Leon. The change would serve as &#8220;a foundational pillar for institutional adoption.&#8221;</p>

<h2 class="ArticleBody-subtitle"><a id="headline2"/>3. Gives the CFTC more power to regulate digital assets </h2>
<div class="group">
<p>The text gives more power to the CFTC, empowering it to work in tandem with the Securities and Exchange Commission to issue joint rulemaking on crypto-related matters.</p>
<p>&#8220;There&#8217;s a lot more power or authority delegated to the CFTC to have jurisdiction over this industry,&#8221; Carbone said. </p>
<p>The shift comes after the SEC for years served as the main regulator of digital assets, after it edged out the CFTC to gain authority over the industry. </p>
</div>
<h2 class="ArticleBody-subtitle"><a id="headline3"/>4. Allows the CFTC to collect fees</h2>
<div class="group">
<p>The draft calls for regulated entities to pay fees to the CFTC. Those fees would go toward registering digital commodity exchanges, brokers and dealers, in addition to conducting oversight of regulated entities and carrying out education and outreach. </p>

<h2 class="ArticleBody-subtitle"><a id="headline4"/>5. Establishes listing standards for tokens</h2>
<div class="group">
<p>The text calls for crypto exchanges to only permit trading of digital commodities that are &#8220;not readily susceptible to manipulation.&#8221;</p>
<p>It&#8217;s a provision that could reduce the number of &#8220;rug pulls&#8221; and other scams that are still common in some parts of the crypto industry, with the goal of establishing standards and building confidence in the market. </p>

<h2 class="ArticleBody-subtitle"><a id="headline5"/>What&#8217;s next?</h2>
<div class="group">
<p>The Senate Agriculture Committee&#8217;s discussion draft is far from final, but it does offer critical insights into the direction of efforts to pass crypto-friendly regulations in the U.S., according to Carbone.</p>
<p>&#8220;It&#8217;s not final, it&#8217;s not done, but this gives a good sense of where Congress is going and what the final rules may be,&#8221; Carbone said. </p>
<p>The committee will likely spend the next few weeks getting feedback on their draft, meaning it may be &#8220;almost impossible to get [a final version of this part of the bill] done by the end of the year,&#8221; he added.</p>
<p>However, that period will give lawmakers time to offer more concrete guidance on several issues that are bracketed – or not yet finalized – in the discussion draft. Those include provisions on anti-money laundering rules and regulations specific to decentralized finance players.</p>
<p>Several crypto players plan to work in tandem with lawmakers to help iron out those details, among others. </p>
<p>&#8220;We&#8217;ve long said crypto is a bipartisan issue, and this draft from Chairman Boozman and Senator Booker reflects that,&#8221; Moonpay President Keith Grossman told CNBC. &#8220;It&#8217;s critical that legislation distinguishes between centralized intermediaries and decentralized systems, and we look forward to working with the Committee to get it right.&#8221;</p>
<p>The discussion draft is only one piece of larger legislative efforts to overhaul regulations for the crypto industry, according to Carbone. Ultimately, the text will be combined with the Senate Banking Committee&#8217;s draft on the digital assets market structure in a bid to create one comprehensive bill.</p>
<p>And although lawmakers are nowhere near the finish line in that process, crypto firms are finding other ways to work with regulators and other authorities to meaningfully advance their industry, Grayscale Investments Chief Legal Officer Craig Salm told CNBC.</p>
<p>&#8220;In the absence of comprehensive legislation, we&#8217;ve still seen meaningful progress on the regulatory front,&#8221; Salm said, adding that the SEC, Internal Revenue Service and Treasury Department have recently provided guidance around staking in crypto exchange-traded products. &#8220;That said, thoughtful legislation will be critical to solidifying the foundation of the digital asset industry in the U.S. and unlocking even greater value for investors and consumers.&#8221;</p>

<p>Based on reports from on‑chain tracker <a href="https://x.com/lookonchain/status/1940993660839215510?ref_src=twsrc%5Etfw" target="_blank" rel="noopener nofollow">Lookonchain</a>, one wallet that snapped up 10,000 BTC for $7,805 back in April 2011 moved its entire holding within hours.</p>
<p>That original haul, bought when Bitcoin traded at $0.78, is now worth over $1  billion. Moments later, a second address transferred another 10,000  BTC, taking the total to 20,000  BTC shifted in one morning.</p>
<p>That equates to a jaw‑dropping 140,000× return on the tiny initial outlay. Analysts caution it may not be a single individual behind both wallets, but the timing grabbed attention.</p>

<p>The man suspected of killing a Minnesota lawmaker and wounding another has been taken into custody, two law enforcement officials said, bringing an end to a nearly two-day search that put the state on edge.</p>
<p>Vance Boelter was arrested Sunday evening. The arrest was confirmed to The Associated Press by law enforcement officials were who were not authorized to publicly discuss details of the ongoing investigation and spoke to AP on condition of anonymity. Former Democratic <a href="https://apnews.com/article/minnesota-lawmakers-shot-197b8073b66449297986f8276e6dcfc9" target="_blank" rel="noopener">House Speaker Melissa Hortman</a> and her husband, Mark, were killed in their Brooklyn Park home early Saturday in the northern Minneapolis suburbs. Sen. John Hoffman, also a Democrat, and his wife, Yvette, were injured at their Champlin home, about 9 miles (about 15 kilometers) away.</p>
<p>Boelter was captured in Minnesota, though officials didn’t immediately say where.</p>
<p>A criminal complaint unsealed Sunday night says Boelter faces two counts of second-degree murder and two counts of attempted second-degree murder in the deaths of the Hortmans and the wounding of Hoffman and his wife.</p>
<p>The Hoffmans were attacked first at their home in Champin early Saturday. After police in nearby Brooklyn Park learned of that shooting, they sent patrol officers to check on the Hortmans’ home.</p>
<p>Brooklyn Park police officers arrived just in time to see Boelter shoot Mark Hortman through the open door of the home, the complaint says. It says they exchanged gunfire with Boelter, who fled inside the home before escaping the scene.</p>
<p>The complaint indicates the shooting at the Hoffmans’ home was called in by their adult daughter.</p>

<h4 class="wp-block-heading">A massive search</h4>
<p>Earlier Drew Evans, superintendent of the Bureau of Criminal Apprehension, said authorities found a car very early Sunday they believed Boelter was using, a few miles from his home in Green Isle, in the farm country about an hour west of Minneapolis. He also said they found evidence in the car that was relevant to the investigation, but did not provide details.</p>
<p>Authorities named Boelter, 57, as a suspect, saying he wore a mask as he posed as a police officer, even allegedly altering a vehicle to make it look like a police car.</p>
<p>Evens confirmed that investigators found a cowboy hat near the vehicle and believe it belonged to Boelter. The superintendent also said authorities interviewed Boelter’s wife and other family members in connection with Saturday’s shootings. He said they were cooperative and were not in custody.</p>
<p>The FBI had issued a reward of up to $50,000 for information leading to his arrest and conviction.</p>
<p>More than 100 law enforcement officers including SWAT teams were searching the area, including nearby homes, Evans said. He also said they had received more than 400 tips from the public.</p>
<p>The earlier search happened in rural Sibley County, roughly 50 miles (80 kilometers) southwest of Minneapolis, where Boelter had a home with his wife and five children. Residents in the area received an emergency alert about the located vehicle that warned them to lock their doors and cars.</p>
<p>The shootings&nbsp;<a href="https://apnews.com/article/political-violence-assassination-minnesota-trump-3c750cff0749633872ab6101bfa23b23" target="_blank" rel="noopener">come</a>&nbsp;as&nbsp;<a href="https://apnews.com/article/arson-pennsylvania-governor-political-violence-388da01e84661fb12ac79c626b0004eb" target="_blank" rel="noopener">political leaders nationwide</a>&nbsp;have been attacked, harassed and intimidated amid deep political divisions.&nbsp;<a href="https://Lawmakers on Sunday continued to reel from the shooting of two Democratic Minnesota state legislators in their homes that led to the death of one and her husband, contemplating a previously unthinkable world where democratically-elected representatives need full-time security details to protect them from the public.">Lawmakers said they were disturbed</a>&nbsp;by the attacks as Twin Cities residents mourned.</p>
<p>Brightly colored flowers and small American flags were placed Sunday on the gray marbled stone of the Minnesota State Capitol along with a photo of the Hortmans. People scrawled messages on small notes including, “You were our leader through the hardest of times. Rest in Power.”</p>
<p>Pam Stein came with flowers and kneeled by the memorial. An emotional Stein called Hortman an “absolute powerhouse” and “the real unsung hero of Minnesota government.”</p>
<h4 class="wp-block-heading">No details on motive</h4>
<p>Authorities have not yet given details on a motive.</p>
<p>A list of about 70 names was found in writings recovered from the fake police vehicle that was left at the crime scene, the officials said. The writings and list of names included prominent state and federal lawmakers and community leaders, along with abortion rights advocates and information about healthcare facilities, according to the officials.</p>
<p>Evans clarified that while he described the materials on Saturday as a “manifesto,” the papers were not a political or ideological treatise. He said it was more of a notebook, listing lawmakers and other people, with various thoughts mixed in. He declined to give details.</p>
<p>A Minnesota official told AP lawmakers who had been outspoken in favor of abortion rights were on the list. The official spoke on the condition of anonymity because the investigation was ongoing.</p>
<p>The attacks prompted warnings to other state elected officials and the cancellation of planned&nbsp;<a href="https://apnews.com/article/no-kings-protest-trump-philadelphia-los-angeles-immigration-raids-a3b67d23733cd060f8d01aef1e391dbf" target="_blank" rel="noopener">“No Kings” demonstrations</a>&nbsp;against President Donald Trump, though some went ahead anyway, including one that drew tens of thousands to the State Capitol in St. Paul. Authorities said the suspect had “No Kings” flyers in his car.</p>
<p>Boelter is a former political appointee who served on the same state workforce development board as Hoffman, records show, though it was not clear if or how well they knew each other.</p>
<p>Around 6 a.m. Saturday, Boelter texted friends to apologize for his actions, though he didn&#8217;t say what he had done.</p>
<p>“I’m going to be gone for a while. May be dead shortly, so I just want to let you know I love you guys both and I wish it hadn’t gone this way. … I’m sorry for all the trouble this has caused,&#8221; he wrote in messages viewed by AP.</p>
<h4 class="wp-block-heading">Two Democrats targeted</h4>
<p>On Sunday evening, U.S. Sen. Amy Klobuchar shared a statement from Yvette Hoffman expressing appreciation for the outpouring of public support.</p>
<p>“John is enduring many surgeries right now and is closer every hour to being out of the woods,” Yvette Hoffman said in a&nbsp;<a href="https://x.com/amyklobuchar/status/1934383694342434882?s=46&amp;t=Aj2rKECUjm-cecTWvlgvjw">text that Klobuchar posted</a>&nbsp;on social media. “He took 9 bullet hits. I took 8 and we are both incredibly lucky to be alive. We are gutted and devastated by the loss of Melissa and Mark.”</p>
<p>On social media, Gov. Tim Walz remembered Hortman on Sunday as, “The most consequential Speaker in state history.”</p>
<p><a href="https://apnews.com/article/minnesota-lawmakers-shot-hortman-d5b1788f4ad91c00e5b5b1c24707f2ce" target="_blank" rel="noopener">Hortman</a>, 55, had been the top Democratic leader in the state House since 2017. She led Democrats in a&nbsp;<a href="https://apnews.com/article/minnesota-legislature-power-struggle-republicans-democrats-7db12f51ad0e47d49f4c50f56cb1e5c4" target="_blank" rel="noopener">three-week walkout</a>&nbsp;at the beginning of this year’s session in a power struggle with Republicans. Under a power-sharing agreement, she turned the gavel over to Republican Rep. Lisa Demuth and assumed the title speaker emerita.</p>
<p>Hortman used her position as speaker in 2023 to champion expanded protections for abortion rights, including legislation to solidify Minnesota’s status as a refuge for patients from restrictive states who travel to the state to seek abortions — and to protect providers who serve them.</p>
<p>The couple had an adult son and an adult daughter.</p>
<p>Hoffman, 60, was first elected in 2012 and was chair of the Senate Human Services Committee, which oversees one of the biggest parts of the state budget. He and his wife have one adult daughter.</p>

Greg Abbott&#8217;s desk.</p>
<p>The changes would not expand abortion access in Texas or list specific medical exceptions under the state&#8217;s near-total ban, which took effect in 2022 and only allows for an abortion to save the life of the mother. It also would not include exceptions for cases of rape or incest.</p>
<p>But the proposal is still a pivot for Texas <span class="link"><a href="https://www.cbsnews.com/texas/news/conservative-lawmakers-express-concerns-about-bipartisan-bill-clarifying-medical-exceptions-to-texas-abortion-law/" target="_blank" data-invalid-url-rewritten-http="" rel="noopener">Republicans</a></span>, who for years have defended the law as written in the face of legal challenges and pleas for clarity from medical providers. <span class="link"><a href="https://www.cbsnews.com/texas/news/conservative-lawmakers-express-concerns-about-bipartisan-bill-clarifying-medical-exceptions-to-texas-abortion-law/" target="_blank" data-invalid-url-rewritten-http="" rel="noopener">Democrats</a></span>, meanwhile, have called the bill a positive step but also faced criticism from some abortion-rights allies who raised doubts about what, if any, impact it will have.</p>
<p>The bill would specify that doctors cannot face criminal charges for performing an abortion in a medical emergency that causes major bodily impairment. It also defines a &#8220;life-threatening&#8221; condition as one capable of causing death.  </p>
<p><a href="https://capitol.texas.gov/BillLookup/History.aspx?LegSess=89R&amp;Bill=SB31" target="_blank" rel="nofollow noopener">Senate Bill 31</a> passed 129-6 and needs only a final procedural vote before reaching Abbott, who has signaled support for the measure.</p>
<h2>North Texas doctor has mixed feelings toward the bill</h2>
<p>Three years ago, Dr. Austin Dennard <span class="link"><a href="https://www.cbsnews.com/news/abortions-up-slightly-2024-fewer-women-out-of-stgate-for-them-guttmacher/" target="_blank" data-invalid-url-rewritten-http="" rel="noopener">traveled outside Texas for an abortion</a></span> after her fetus was diagnosed with a fatal condition. She later testified in a lawsuit about how the state&#8217;s near-total ban on abortion put her health at risk.</p>
<p>Dennard&#8217;s feelings are mixed about the bill, which does not list specific medical conditions or include fatal fetal anomalies as exceptions.</p>
<p>&#8220;What is broadly now known among practicing physicians in Texas is that abortions are illegal,&#8221; said Dennard, an OB-GYN in Dallas. &#8220;Undoing that broad understanding is going to be difficult.&#8221;</p>
<h2>Moves to clarify medical exemptions</h2>
<p>Lawmakers in at least nine states with abortion bans have sought to change or clarify medical exceptions that allow doctors to perform an abortion if the mother&#8217;s life is at risk since <span class="link"><a href="https://www.cbsnews.com/news/roe-v-wade-overturned-abortion-questions/" target="_blank" data-invalid-url-rewritten-http="" rel="noopener">Roe v. Wade was overturned</a></span> nearly three years ago, according to the Guttmacher Institute, a research organization that supports abortion rights. </p>
<p>Supporters of these bills have said they have the potential to save lives. Critics, including some abortion rights groups, have questioned whether they make state abortion laws easier to understand.</p>
<p>In Kentucky, Democratic Gov. Andy Beshear earlier this year vetoed a bill that GOP lawmakers touted as bringing clarity to that state&#8217;s near-total abortion ban, saying it would not protect pregnant women. Republican lawmakers later overrode his veto. </p>
<p>Last year, South Dakota released a video for physicians that outlined examples of acceptable medical emergencies, which received criticism from abortion rights supporters for not being specific enough. </p>
<p>&#8220;I think these bills are trying to get at the reality that exceptions are really hard to comply with,&#8221; said Kimya Forouzan, principal state policy adviser at the Guttmacher Institute. </p>
<p>Still, Texas Republican Sen. Bryan Hughes, an architect of the state&#8217;s abortion ban, said the new bill&#8217;s goal is to avoid confusion among doctors.</p>
<p>&#8220;One of the most important things we want to do is to make sure that doctors and hospitals and the hospital lawyers are trained on what the law is,&#8221; Hughes said.</p>
<h2>Navigating exceptions under abortion bans</h2>
<p>In 2024, the Texas Supreme Court ruled against Dennard and a group of women who said they were denied abortions after experiencing serious pregnancy complications that threatened their lives and fertility. The court ruled that the state&#8217;s laws were clear in allowing doctors to perform an abortion to save the life of the mother.</p>
<p>Texas&#8217; efforts underscore the challenges abortion opponents have had to navigate regarding medical exceptions, said Mary Ziegler, a professor at the University of California, Davis School of Law and a historian of abortion politics in the U.S.</p>
<p>Judges have put enforcement of Utah&#8217;s abortion ban on hold in a case over exceptions, for example, and they struck down two Oklahoma bans over medical exceptions – though most abortions in that state remain illegal.</p>
<p>For abortion opponents, Ziegler said, it&#8217;s tricky to craft legislation that does two different things.</p>
<p>&#8220;Can you provide clear guidance as to when medical intervention is justified without providing physicians discretion to provide abortions they don&#8217;t think are emergencies?&#8221; Ziegler said. </p>
<h2>Texas may advance other anti-abortion laws </h2>
<p>Texas&#8217; ban prohibits nearly all abortions, except to <span class="link"><a href="https://www.cbsnews.com/texas/news/texas-lt-gov-dan-patrick-legislature-clarify-texas-abortion-law-protect-mothers-at-risk/" target="_blank" data-invalid-url-rewritten-http="" rel="noopener">save the life of the mother</a></span>, and doctors can be fined up to $100,000 and face up to 99 years in prison if convicted of performing an abortion illegally.</p>
<p>Attorney General Ken Paxton&#8217;s office has filed criminal charges against a midwife for allegedly providing illegal abortions and is also <span class="link"><a href="https://www.cbsnews.com/news/texas-judge-fines-new-york-doctor-prescribing-abortion-pills-woman-near-dallas/" target="_blank" data-invalid-url-rewritten-http="" rel="noopener">suing a New York doctor</a></span> for prescribing abortion pills to a Texas woman.</p>
<p>Texas Republicans are also advancing efforts to make it a civil offense to mail, deliver or manufacture abortion pills, expanding on a 2021 law that allows private individuals to sue others whom they suspect are helping a woman obtain an abortion.</p>
