A jury in Miami has determined that Tesla should be held partly liable for a fatal 2019 Autopilot crash, and must compensate the family of the deceased and an injured survivor a portion of $329 million in damages.

Tesla’s payout is based on $129 million in compensatory damages, and $200 million in punitive damages against the company.

The jury determined Tesla should be held 33% responsible for the fatal crash. That means the automaker would be responsible for about $42.5 million in compensatory damages. In cases like these, punitive damages are typically capped at three times compensatory damages.

The plaintiffs’ attorneys told CNBC on Friday that because punitive damages were only assessed against Tesla, they expect the automaker to pay the full $200 million, bringing total payments to around $242.5 million.

Tesla said it plans to appeal the decision.

Attorneys for the plaintiffs had asked the jury to award damages based on $345 million in total damages. The trial in the Southern District of Florida started on July 14.

The suit centered around who shouldered the blame for the deadly crash in Key Largo, Florida. A Tesla owner named George McGee was driving his Model S electric sedan while using the company’s Enhanced Autopilot, a partially automated driving system.

While driving, McGee dropped his mobile phone that he was using and scrambled to pick it up. He said during the trial that he believed Enhanced Autopilot would brake if an obstacle was in the way. His Model S accelerated through an intersection at just over 60 miles per hour, hitting a nearby empty parked car and its owners, who were standing on the other side of their vehicle.

Naibel Benavides, who was 22, died on the scene from injuries sustained in the crash. Her body was discovered about 75 feet away from the point of impact. Her boyfriend, Dillon Angulo, survived but suffered multiple broken bones, a traumatic brain injury and psychological effects.

“Tesla designed Autopilot only for controlled access highways yet deliberately chose not to restrict drivers from using it elsewhere, alongside Elon Musk telling the world Autopilot drove better than humans,” Brett Schreiber, counsel for the plaintiffs, said in an e-mailed statement on Friday. “Tesla’s lies turned our roads into test tracks for their fundamentally flawed technology, putting everyday Americans like Naibel Benavides and Dillon Angulo in harm’s way.”

Following the verdict, the plaintiffs’ families hugged each other and their lawyers, and Angulo was “visibly emotional” as he embraced his mother, according to NBC.

The verdict comes as Musk, Tesla’s CEO, is trying to persuade investors that his company can pivot into a leader in autonomous vehicles, and that its self-driving systems are safe enough to operate fleets of robotaxis on public roads in the U.S.

Tesla shares dipped 1.8% on Friday and are now down 25% for the year, the biggest drop among tech’s megacap companies.

The verdict could set a precedent for Autopilot-related suits against Tesla. About a dozen active cases are underway focused on similar claims involving incidents where Autopilot or Tesla’s FSD— Full Self-Driving (Supervised) — had been in use just before a fatal or injurious crash.

The National Highway Traffic Safety Administration initiated a probe in 2021 into possible safety defects in Tesla’s Autopilot systems. During the course of that investigation, Tesla made changes, including a number of over-the-air software updates.

The agency then opened a second probe, which is ongoing, evaluating whether Tesla’s “recall remedy” to resolve issues with the behavior of its Autopilot, especially around stationary first responder vehicles, had been effective.

The NHTSA has also warned Tesla that its social media posts may mislead drivers into thinking its cars are capable of functioning as robotaxis, even though owners manuals say the cars require hands-on steering and a driver attentive to steering and braking at all times.

A site that tracks Tesla-involved collisions, TeslaDeaths.com, has reported at least 58 deaths resulting from incidents where Tesla drivers had Autopilot engaged just before impact.

AstroAI is recalling 249,100 minifridges on Wednesday over fire and burn hazards after two of the compact refrigerators caught fire, resulting in hundreds of thousands of dollars in property damage. 

The personal refrigerators’ electrical switch can short circuit, posing fire and burn risks, according to a notice from the Consumer Product Safety Commission (CPSC).

CPSC has received at least 70 reports of the minifridges emitting smoke, burning, melting or catching fire. Two fires caused more than $360,000 in property damages, the recall notice states.

Manufactured in China, the recalled 4-liter, 6-can capacity minifridges measure 9.45 inches in diameter, 6.9 inches wide and 10 inches tall. Available in black, white, blue and pink, the fridges were sold online for about $40 on Amazon.com and Astroai.com from June 2019 through June 2022. 

The recalled minifridges’ model number is LY0204A, which is printed on a label on the back of the product. Nine-digit serial numbers of the affected units starts with “S/N” and begin with either 19, 20, 21, 2201, 2202 or 2203.

Consumers with the recalled fridges are urged to immediately stop using them and to contact AstroAI by email at recall@astroai.com or through a dedicated page on the company’s website at  https://www.astroai.com/product-recall for a replacement product.

Disposal of the recalled minifridges should be in accordance with state and local waste disposal procedures, the CPSC states.

The jury ruled last week that the egg producers used various means to limit the domestic supply of eggs to increase the price of products during the 2000s. The time frame of the conspiracy was an issue throughout the case; jurors ultimately determined damages occurred between 2004 and 2008.

The damages verdict was reached Friday in the Northern District of Illinois. According to federal antitrust law, the damages are automatically tripled, bringing the total to over $53 million. Court documents on the verdict were not readily available Friday evening, but statements from the manufacturers’ attorney and one of the egg producers confirmed a total of about $17.7 million.

“We are extremely grateful for the jury’s service and findings,” Brandon Fox, an attorney representing the food manufacturers, said in a statement. “This was an important case for many reasons, and the jury’s award recognizes its significance.”

Attorneys for the four egg suppliers named in the lawsuit did not immediately return phone messages on Friday. Court documents show the defendants have denied the claims.

The egg suppliers include the family company of its former Chair John Rust, who’s running for the U.S. Senate in Indiana. In a written statement on the verdict, Rust said the jury’s decision “will be appealed.”

The jury found that the egg suppliers exported eggs abroad to reduce the overall supply in the domestic market, as well as limited the number of chickens through means including cage space, early slaughter and flock reduction, court documents say.

Jurors were specifically told not to consider more recent changes in egg pricing during their deliberations.

Food manufacturers joining as plaintiffs in the lawsuit against the egg producers are Kraft Foods Global, Inc., The Kellogg Company, General Mills, Inc. and Nestle USA, Inc. The jury found the egg suppliers who participated in the conspiracy were Cal-Maine Foods, Inc., United Egg Producers, Inc., United States Egg Marketers, Inc. and Rose Acre Farms, Inc., a southern Indiana-based company previously chaired by Rust.

Rose Acre Farms, which identifies itself as the second-largest egg producer in the U.S., disagreed with the jury’s verdict in a written statement.

“Rose Acre has and continues to steadfastly deny being part of any anticompetitive egg price-fixing conspiracy, and we will continue to explore and consider all legal options, including post-trial relief and appeal,” the statement said.

Cal-Maine Foods, Inc. said in a written statement it has petitioned the court to rule in its favor and will continue to evaluate its options, “including, if necessary, an appeal.”

“Cal-Maine Foods respects the jury’s decision and appreciates that the damages awarded by the jury are relatively modest compared to the damages sought but remains disappointed with the verdict as Cal-Maine Foods continues to believe that the Company did nothing wrong,” the statement said.

Email messages sent to the United Egg Producers and United States Egg Marketers representatives were not immediately returned Friday.

In his statement, Rust attacked his opponent U.S. Rep. Jim Banks, saying he has sided with “mega corporations over the American farmer” in the aftermath of the jury’s ruling.

“Voters can be certain that, if elected, Banks will bring his anti-agriculture and pro-mega corporation platform to the chamber,” Rust said.

In response, Banks said in a written statement, “Hoosiers aren’t going to vote for a crook.”

Rust is currently suing Indiana’s Secretary of State over a contested state law that could prevent his name from getting on the primary ballot as a Republican candidate. According to the law, a candidate must vote in two primaries with the party they are affiliated with or the county party chair must approve their candidacy. Rust has argued the law is unconstitutional and vague.

Rust faces an uphill battle for the GOP nomination: Banks has received the endorsement of the Indiana Republican Party and former President Donald Trump. The seat is currently held by Republican Mike Braun, who is instead running for governor next year.

An important Pfizer pharmaceutical plant in North Carolina was severely damaged on Wednesday after a powerful tornado ripped through the area, threatening production lines that normally provide huge amounts of medicine to U.S. hospitals. Meanwhile, torrential rain flooded parts of Kentucky and communities from California to South Florida endured scorching heat that at times reached record-high temperatures.

Pfizer confirmed the large manufacturing complex was damaged by a twister that touched down shortly after midday near Rocky Mount, but said in an email that it had no reports of serious injuries. A later company statement said all employees were safely evacuated and accounted for.

Parts of roofs were ripped open at the Pfizer plant in Rocky Mount, which is a complex composed of several massive buildings. The plant stores large quantities of medicine that were tossed about, said Nash County Sheriff Keith Stone.

“I’ve got reports of 50,000 pallets of medicine that are strewn across the facility and damaged through the rain and the wind,” Stone said.

The plant produces anesthesia and other drugs as well as nearly 25% of all sterile injectable medications used in U.S. hospitals, Pfizer said on its website. Erin Fox, senior pharmacy director at University of Utah Health, said the damage “will likely lead to long-term shortages while Pfizer works to either move production to other sites or rebuilds.”

“We are assessing the situation to determine the impact on production. Our thoughts are with our colleagues, our patients, and the community as we rebuild from this weather incident,” Pfizer tweeted on Wednesday.

The National Weather Service said in a tweet that the damage in North Carolina was consistent with an EF3 tornado with wind speeds up to 150 mph.

The Edgecombe County Sheriff’s Office, where part of Rocky Mount is located, said on Facebook that they had reports of three people injured in the tornado, and that two of them had life-threatening injuries.

A preliminary report from neighboring Nash County said 13 people were injured and 89 structures were damaged, WRAL-TV reported.

Three homes owned by Brian Varnell and his family members in the nearby Dortches area were damaged. He told the news outlet he is thankful they are all alive. His sister and her children hid in their home’s laundry room.

“They got where they needed to be within the house and it all worked out for the best,” Varnell said near a home that was missing exterior walls and a large chunk of the roof.

Elsewhere in the U.S., an onslaught of searing temperatures and rising floodwaters continued, with Phoenix breaking an all-time temperature record and rescuers pulling people from rain-swamped homes and vehicles in Kentucky.

Forecasters said little relief appears in sight from the heat and storms. For example, Miami has endured a heat index of 100 degrees Fahrenheit (37.8 degrees Celsius) or more for weeks, with temperatures expected to rise this weekend.

In Kentucky, meteorologists warned of a “life-threatening situation” in the communities of Mayfield and Wingo, which were inundated by flash flooding this week from thunderstorms. Kentucky Gov. Andy Beshear declared a state of emergency there Wednesday as more storms threatened.

Forecasters expect up to 10 inches of rain could yet fall on parts of Kentucky, Illinois and Missouri near where the Ohio and Mississippi rivers converge.

The storm system is forecast to move Thursday and Friday over New England, where the ground remains saturated after recent floods. In Connecticut, a mother and her 5-year-old daughter died after being swept down a swollen river Tuesday. In southeastern Pennsylvania, a search continued for two children caught in flash flooding Saturday night.

Meanwhile, Phoenix broke an all-time record Wednesday morning for a warm low temperature of 97 degrees Fahrenheit, raising the threat of heat-related illness for residents unable to cool off adequately overnight. The previous record was 96 degrees Fahrenheit in 2003, the weather service reported.

Lindsay LaMont, who works at the Sweet Republic ice cream shop in Phoenix, said business had been slow during the day with people sheltering inside to escape the heat. “But I’m definitely seeing a lot more people come in the evening to get their ice cream when things start cooling off,” LaMont said.

Heat-related deaths continue to rise in Maricopa County, where Phoenix is located. Public health officials Wednesday reported that six more heat-associated fatalities were confirmed last week, bringing the year’s total so far to 18. All six deaths didn’t necessarily occur last week as some may have happened weeks earlier but were confirmed as heat-related only after a thorough investigation.

By this time last year, there had been 29 confirmed heat-associated deaths in the county and another 193 were under investigation.

Phoenix, a desert city of more than 1.6 million people, set a separate record Tuesday among U.S. cities by marking 19 straight days of temperatures of 110 degrees Fahrenheit or more. It topped 110 degrees again Wednesday.

National Weather Service meteorologist Matthew Hirsh said Phoenix’s 119-degree high Wednesday tied the fourth-highest temperature recorded in the city ever. The highest temperature of all time was 122 degrees Fahrenheit, set in 1990. Thursday marked the tenth consecutive day where Phoenix saw daily low temperatures that were still above 90 degrees, officials said.

“Phoenix has now had 10 (consecutive) days with 90+ °F lows so far this year, which is above the annual average of 7 days. Low temperatures in the 90s remain in the forecast for Phoenix through at least the remainder of this week,” NWS Phoenix tweeted on Thursday morning.

Across the country, Miami marked its 16th straight day of heat indexes in excess of 105 degrees. The previous record was five days in June 2019.

“And it’s only looking to increase as we head into the later part of the week and the weekend,” said Cameron Pine, a National Weather Service meteorologist.

The region has also seen 38 consecutive days with a heat index threshold of 100 degrees, and sea surface temperatures are reported to be several degrees warmer than normal.

“There really is no immediate relief in sight,” Pine said.

A 71-year-old Los Angeles-area man died at a trailhead in Death Valley National Park in eastern California on Tuesday afternoon as temperatures reached 121 degrees Fahrenheit or higher and rangers suspect heat was a factor, the National Park Service said in a statement Wednesday.

It is possibly the second heat-related fatality in Death Valley this summer. A 65-year-old man was found dead in a car on July 3.

Human-caused climate change and a newly formed El Nino are combining to shatter heat records worldwide, scientists say.

The entire globe has simmered to record heat both in June and July. Nearly every day this month, the global average temperature has been warmer than the unofficial hottest day recorded before 2023, according to University of Maine’s Climate Reanalyzer.

Atmospheric scientists say the global warming responsible for unrelenting heat in the Southwest also is making extreme rainfall a more frequent reality.
